The Numbers
After 2015, a year in which over one million refugees and migrants traveled to the EU, 362,376 people arrived in 2016 by crossing the Mediterranean Sea. Of the 362,376 refugees and migrants that arrived by sea in 2016, 48% entered through Greece (Eastern Mediterranean Route), 50% through Italy (Central Mediterranean Route), and 2% through Spain (Western Mediterranean Route). Once migrants and asylum-seekers entered the EU through Greece, they tried to continue their journey towards Western Europe vis-à-vis the Western Balkan Route (through Macedonia, Serbia, Hungary, and Croatia). Syrians, Iraqis and Afghanis were the predominant nationalities of those that made use of the Western Balkan Route. Overall, refugees and migrants traveled out of the following countries: Syria (23%), Afghanistan (12%), Nigeria (10%), Iraq (8%), Eritrea (6%), Guinea (4%), Côte d’Ivoire (4%), The Gambia (4%), Pakistan (3%), and Senegal (3%). In 2016, approximately 1,195,265 asylum applications were filed and the top five nationalities of asylum applications were Syria, Afghanistan, Iraq, Pakistan, and Iran. The top five destination countries for asylum seekers were Germany, Italy, France, Greece, and the UK. Approximately 56% of first instance asylum applications received a positive decision. The United Nations High Commissioner for Refugees (UNHCR) Accommodation/Relocation Program currently provides those whose applications either have not yet been reviewed or those who have received a negative decision with temporary places to stay either in “apartments, hotel buildings, host families and relocation sites with services,” which serve as alternatives to camps.

Events
In February and March of 2016, Macedonia closed its border along the northern part of Greece. The move by Macedonia was “part of a chain reaction” of border restrictions in both Slovenia and Serbia. This coordinated effort resulted in the closure of the Western Balkan Route, stranding thousands of migrants, mostly Syrian and Iraqi migrants, on the Greek side of the border. In the same month, the EU and Turkey executed a deal (The “EU-Turkey Statement”), in which “Ankara would take back all illegal migrants who cross to Greece, including Syrians, in return for the EU taking in thousands of Syrian refugees directly from Turkey and rewarding it with more money, early visa-free travel and progress in its EU membership negotiations.” The UNHCR argues that the EU-Turkey Statement’s commitment to pushing refugees back into Turkey and Syria where they face persecution is a violation of the European Convention of Human Rights. Additionally, as a result of the Balkan border closures and the implementation of the EU-Turkey Statement, migrant camps across Greece were turned into quasi-detention centers. Thousands of people fleeing war torn countries such as Syria and Iraq found themselves at the mercy of the Greek government and the EU-Turkey Statement’s directive. Organizations such as Amnesty International, Human Rights Watch, and Doctors Without Borders have publicly criticized the Greek government’s treatment of detained refugees and the conditions as “inhumane” and “fetid.”

Theresa May, the Prime Minister of the UK, has announced plans for the British military to opt out of parts of the European Convention on Human Rights (ECHR) in future military conflicts and instead to adopt a so-called “British Bill of Rights.” This move is something that David Cameron, the former Prime Minister of the UK, alluded to previously.

History of the ECHR

The UK has been a signatory of the ECHR since 1951. However, the Convention is not self-executing, thus it required the UK to pass legislation domestically in order for its content to become effective law within the UK. This legislation was passed in the form of the “Human Rights Act” (HRA) in 1998 after Tony Blair’s Labor Party introduced it.

The ECHR actually stems from membership of the Council of Europe, not from the European Union, thus Brexit does not really affect this move. Though it is true that a country must be a member of the Council of Europe in order to be a member of the European Union, the reverse is not true, and it has not been suggested that the UK is also leaving the Council of Europe at this point.

What the Bill of Rights Would Look Like

The changes would involve derogation from the content of Articles Two (right to life) and Five (right to liberty) of the ECHR, but the UK would still be following the other mainstays of the convention such as the prohibition on torture. These derogations could only happen in times of war or public emergencies that threaten the life of the nation.

A British Bill of Rights would likely look nearly identical to the current Human Rights Act (HRA) but with a spattering of traditionally granted British rights which are not covered by the HRA, such as the right to a trial by jury. Most of the current content of the HRA stems from longstanding protections which British law offers its citizenry anyway. The greatest issue is that the UK is one of the few countries in Europe to have a common law system; most others have a variation of a Roman and civil law system, but this issue could be overcome by simply making the British Bill of Rights justiciable only in a common law court.

What the Ramifications of a Switch Might Be

This would likely not be a particularly contentious move, especially given the media’s main focus on the UK exiting from the European Union rather than on this smaller, separate issue. Other countries such as Turkey, the Ukraine, and France have given notice that they would derogate from the ECHR before, with no real ramifications. Additionally, many citizens of the UK may be supportive of this move as it is intended to shield the UK from some legal claims of military misconduct, which they have spent over 100 million pounds ($123 million) on since 2004 for cases regarding their presence in Iraq. Internationally, it is difficult to predict what the reaction would be, but one could assume it would just be seen as a reaffirmation of the British desire to distance themselves from the rest of Europe in certain respects.

There likely would not be any concrete legal ramifications because the core content of the ECHR is said to be incorporated in this British Bill of Rights, and the derogation would be limited to times of war and public emergency, which has been allowed previously when other countries derogated. Thus, while it may be frowned upon for them to alter an international obligation, they would still be comporting with the international norms of human rights law but embodied in a different text.

On the other hand, there has been some backlash from certain groups who feel this will only serve to protect those who have something to hide and is being orchestrated by those trying to undermine the rule of law and intimidate solicitors who pursue legitimate cases involving abuse by the British military.

In the case of Trabelsi v. Belgium, the European Court of Human Rights (ECHR) held that the extradition of a Tunisian national from Belgium to the United States violated Article 3 of the European Convention on Human Rights, dealing with the prohibition on inhuman and degrading treatment. Mr. Trabelsi complained that his extradition to the United States exposed him to an irreducible life sentence and was thus a violation of Article 3. ECHR holds that a life sentence is not itself prohibited by Article 3, but is a violation if it is irreducible. Given the gravity of Mr. Trabelsi’s terrorism charges, the relevant U.S. criminal penalties, and the lack of assurances by U.S. authorities to spare Mr. Trabelsi from an irreducible life sentence, the ECHR ruled that Mr. Trabelsi would potentially face an irreducible sentence and his extradition was thus in violation of Article 3.
